Throughout the site, the terms “you” and “your” refer to the user, customer, participant, parent or legal guardian (where applicable). ABHIVYAKTI PTY LTD offers this website, including all information, tools and services available from this site, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.
By visiting our website and/or purchasing, enrolling in, attending, or participating in any Academy class, course, rehearsal, workshop, event, performance-related activity, or service (collectively, “Services”), you agree to be bound by these Terms & Conditions (“Terms”). These Terms apply to all users of the site, including browsers, customers, and contributors of content. If you do not agree to these Terms, you must not access the website or use our Services.
Any new features or tools added to the website or Services will also be subject to these Terms. We reserve the right to update or replace any part of these Terms by posting updates on our website. Continued use of the website or Services after changes are posted constitutes acceptance of the updated Terms.

Definitions
A “Course” means the structured program delivered by the Academy for a stated period (commonly referred to as a “term” in the Academy calendar), including syllabus instruction, scheduled classes, practice expectations, performance preparation, rehearsals, and any extended training sessions included within that Course structure. The “Course Commencement Date” means the published start date of that Course as communicated by the Academy in the enrolment confirmation or official Academy calendar.

Enrolment, Registration and Accuracy of Information
By enrolling in our Services, you agree to provide accurate, current and complete information and to update details if they change. You acknowledge that enrolment is accepted only when confirmed by the Academy (including via confirmation message/email or acceptance of payment), and the Academy reserves the right to accept or decline enrolments at its discretion, including mid-course enrolments where appropriate. The Academy may withdraw or cancel an enrolment where incorrect, misleading, or incomplete information has been provided.
Mid-course enrolments may be accepted at the Academy’s discretion. Where offered, any adjusted fee options will be determined by the Academy’s published enrolment options and do not create any entitlement to attendance-based fee recalculation, refunds, credits, make-ups, or pro-rata adjustments.

Contractual Acceptance
By enrolling in any Course, attending any session, or making any payment to the Academy, you confirm that you have read, understood, and agree to be bound by these Terms, including the Program Structure & Fee Policy and the Refund/Cancellation Policy. You also confirm acceptance of our Privacy Policy, which governs how personal information is handled.

Parent / Guardian Responsibility
For participants under 18 years of age, enrolment must be completed by a parent or legal guardian. The parent/guardian accepts full responsibility for the minor’s participation, medical suitability, behaviour, attendance, and compliance with Academy policies and venue rules.
Parents/guardians remain responsible for safe drop-off and pick-up arrangements. Unless the Academy explicitly confirms in writing that supervision applies before/after class times, the Academy does not provide childcare or supervision outside scheduled class times. The Academy may require a parent/guardian to remain on-site where age, venue requirements, or safety considerations reasonably require it.

Health and Safety
Participation in dance classes involves physical activity and inherent risks. Participants are responsible for ensuring they are medically fit to participate and should consult a medical professional where appropriate. Participants must disclose any relevant medical conditions, injuries, or physical limitations prior to participation. Participants must follow instructor guidance at all times and perform movements only within their physical capabilities. The Academy is not responsible for injuries resulting from failure to follow instructions, failure to disclose relevant medical conditions, or from performing movements beyond personal limitations. The Academy is also not responsible for loss, theft, or damage to personal belongings brought to classes or events.
Media Release
During classes or events, photographs, audio recordings, or video recordings may be taken for promotional, educational, or archival purposes. By enrolling, you grant the Academy permission to use such media for promotional materials, website content, and social media, unless you explicitly opt out in writing prior to participation. Media will not include surnames, contact details, or personal identifying information unless separately consented to in writing. The Academy retains ownership of all such media content created during its programs.

Governing Law
These terms and conditions are governed by and construed in accordance with the laws of Victoria, Australia. Any disputes concerning this website are to be resolved by the courts having jurisdiction in Victoria. We retain the right to bring proceedings against you for breach of these Terms and Conditions, in your country of residence or any other appropriate country or jurisdiction.

Code of Conduct
Respectful behaviour towards instructors, staff, and fellow participants is mandatory. Any form of disruptive, unsafe, or inappropriate behaviour may result in immediate suspension or termination of enrolment without refund. All fee and policy queries must be raised respectfully and through the Academy’s official communication channel. The Academy may decline to engage in repeated or circular discussions once a policy has been clarified. Termination for breach of policy does not waive any outstanding fees payable for the course.​
Program Structure & Fee Policy
Program Structure
Enrolment is strictly course-based. Fees are charged per course and cover the structured syllabus, scheduled classes, performance preparation (if applicable), rehearsals, and extended training sessions within that course. Course fees reflect the overall program structure and not the number of individual classes conducted. The Academy does not guarantee a fixed number of sessions per course, as scheduling may vary due to calendar structure, public holidays, venue availability, or operational requirements. The course fee represents enrolment in the overall training program and not payment for a specific number of individual sessions. Fees are not calculated on a per-class attendance basis. Enrolment confirms acceptance of the Academy’s teaching methodology and training structure. The Academy may change class times, venues, instructors, or class format where reasonably required. Reasonable notice will be provided where possible.
Attendance, Absence, Holidays & Breaks
Regular attendance is encouraged and expected. Absence due to illness, injury, travel, personal commitments, or any other reason does not entitle the participant to fee adjustments, credits, refunds, transfers, or guaranteed make-up sessions. The Academy does not operate on a pro-rata or attendance-adjusted model. Public holidays and scheduled seasonal breaks are incorporated within the overall course structure and do not result in fee reductions. Make-up classes are not guaranteed and may be offered solely at the discretion of the Academy. In cases of long-term medical incapacity (exceeding one full course), requests may be reviewed at the sole discretion of the Academy upon written medical documentation. Scheduled breaks and public holidays are not considered class cancellations.

Payment
Payment for dance classes must be made according to the specified schedule. Failure to make timely payments may result in suspension of participation in classes. Outstanding fees remain payable regardless of attendance. Fees are due for the full course once the course has commenced, irrespective of withdrawal, absence, suspension, or termination. No deductions or reductions will be made for non-attendance for any reason. Payment obligations are not dependent on participation, attendance, or satisfaction with progress once the Course has commenced. The Academy reserves the right to recover unpaid fees through appropriate legal or recovery processes if necessary. The Academy may suspend participation where fees remain unpaid. Suspension does not relieve the participant of payment obligations for the Course.

Fee Revision
The Academy reserves the right to revise fees for future courses. Any changes will be communicated prior to the commencement of the relevant course.

Casual Drop-In Policy
Casual drop-in classes are charged at the published per-class rate and apply only when enrolled specifically under the casual drop-in structure.Regular course enrolment does not convert to casual attendance.

Non-Transferable enrolment
Enrolment is personal to the registered participant and may not be transferred, assigned, or shared with another person.
Refund/Cancellation Policy
Refunds are available only where written cancellation is received at least seven (7) calendar days prior to the official Course Commencement Date. Cancellations made within seven (7) days of the Course Commencement Date, or after the Course has commenced, are not eligible for refunds, credits, transfers, or fee adjustments, except where required under Australian Consumer Law.
Cancellation of a single session does not constitute cancellation of the entire Course. Refunds, credits, or fee adjustments are not automatic and remain at the sole discretion of the Academy, except where required under Australian Consumer Law.
Withdrawal / Early Termination
Withdrawal or early termination from a Course after commencement does not entitle the participant to a refund or fee adjustment. Course fees remain payable in full once the Course has commenced. Notice of withdrawal must be provided in writing. Termination of enrolment, whether initiated by the participant or the Academy (including for breach of policy), does not waive any outstanding fees payable for the relevant Course.

Minimum Enrolment / Course Cancellation
The Academy reserves the right to cancel, postpone, combine, or reschedule a Course where minimum enrolment numbers are not met or where operational requirements reasonably require adjustment. In such cases, participants will be offered a rescheduled course, credit, or refund at the Academy’s discretion.

Performance Participation
Participation in performances, events, competitions, or public presentations is subject to readiness, attendance, conduct, costume requirements, and instructor discretion. The Academy reserves the right to determine eligibility for performance participation.

Force Majeure
The Academy shall not be liable for failure to perform obligations where such failure is due to events beyond reasonable control, including but not limited to natural disasters, government restrictions, pandemics, venue closures, or other unforeseen circumstances.
In such cases, alternative arrangements (including online classes or rescheduling) may be provided at the Academy’s discretion, and such alternative arrangements will be considered fulfilment of the Academy’s obligations. No refunds, credits, or fee adjustments will apply in such circumstances. The Academy reserves the right to deliver classes online or via alternative formats where in-person classes are not possible.
